Terms of Service
The rules for creating, editing, and purchasing through Octopod.
Effective 30 August 20261. Who you contract with
These terms are an agreement between you and DAOstack Technologies Ltd., trading as Octopod, an Israeli private company (company no. 515745651). By accessing or continuing to use Octopod, you agree to these terms. You must be legally able to enter this agreement and, if using Octopod for an organization, authorized to bind it.
2. The service
Octopod is software that uses text prompts and reference images to create and edit downloadable 3D assets. AI-generated results can vary, may not be unique, and may contain defects. We do not guarantee that an output will match a prompt or reference exactly, meet any subjective visual or technical quality threshold, be unique, or be fit for a particular purpose. You are responsible for checking whether an output is suitable and lawful for your intended use before relying on it.
3. Accounts and credits
Keep your account credentials secure and provide accurate information. Credits are prepaid usage units for generation and editing actions. The applicable credit cost is shown before an action begins; a generation is charged only when it produces the completed billable result described by the product. A completed output may still have aesthetic or technical limitations inherent to AI generation. Credits are not money, cannot be transferred between users, and cannot be redeemed for cash.
4. Payment
Current prices and package contents appear on the Pricing page before purchase. The payment provider shown at checkout securely processes the transaction; Octopod does not receive or store your full card number. When Paddle is the displayed provider, Paddle.com acts as Merchant of Record and its Buyer Terms also apply. For purchases processed by Stripe or PayMe, DAOstack Technologies Ltd. remains the seller.
5. Your content
You retain your rights in prompts, images, and other material you submit. You grant us and the service providers involved in your selected workflow a limited license to host, process, transmit, and transform that material only to provide, secure, support, and improve the service. You must have the rights needed to submit it.
As between you and Octopod, you may use generated outputs for lawful personal or commercial purposes. We do not guarantee that copyright or other exclusive rights exist in an AI-generated output, or that similar outputs will not be generated for others.
6. Acceptable use
You must not use Octopod to:
- break the law, defraud, spam, deceive, or facilitate harm;
- infringe intellectual-property, privacy, publicity, or other rights;
- upload malware or interfere with the security or availability of the service;
- probe, scrape, reverse engineer, or bypass technical or usage limits except where law permits;
- resell access to the service or another person's account without written permission.
7. Our intellectual property
Octopod and its software, documentation, design, branding, and underlying technology remain owned by us and our licensors. These terms give you only the limited, non-exclusive, non-transferable right to use the service as intended.
8. Availability and account action
The service is provided without a guarantee of uninterrupted, secure, or error-free operation. We may change or discontinue features. We may suspend or terminate access for a material breach, non-payment, security or fraud risk, or repeated or serious policy violations. Where practical, we will give notice and an opportunity to export available content.
9. Warranties and liability
To the fullest extent permitted by law, Octopod is provided “as is” and we disclaim implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, special, or lost-profit damages. Our total liability arising from the service will not exceed the amount you paid for Octopod in the 12 months before the event giving rise to the claim. Nothing excludes liability that cannot lawfully be excluded, including fraud or liability for death or personal injury caused by negligence where applicable.
10. Governing law
Israeli law governs these terms, without regard to conflict-of-law rules. Courts with jurisdiction over DAOstack Technologies Ltd.'s principal place of business will resolve disputes, unless mandatory consumer law requires otherwise.
